Apps”), mobile applications (“Mobile Apps”), and related services (collectively, the “Platform”, “Services”). We respect your privacy and are committed to protecting the personally identifiable information (the “Personal Data”) you disclose to us or we collect from you.

The purpose of this privacy policy is to assist you in understanding the purpose for which we collect, use, disclose, and process the Personal Data you have provided or we collect from you. DATA ADMINISTRATOR:

Subject to this Privacy Policy and in accordance with data privacy law, WEMASY B.V., located at Sportlaan 45, 6717 LA Ede. Gelderland Netherlands is the owner and controller of personal data processing and the free movement of such data. The data is stored in our database, which is hosted on AWS (www.amazon.com), HETZNER (www.hetzner.com), DigitalOcean (www.digitalocean.com ) and WORLDSTREAM (www.worldstream.com) .

WHAT TYPE OF PERSONAL DATA WE MAY COLLECT FROM YOU?

While using our Platform, we may ask you to provide us with certain personally identifiable information or technical or usage data collected automatically when using our Platform and its Services. For the purpose of this Privacy Policy, “Personal Data” means any information relating to an identified or identifiable individual. Personally identifiable information (PII) we may ask you to provide us may include, but is not limited to, your full name, email address, phone number, mailing and shipping address, city, state, country, zip code, business name, social media profile link and, technical or usage data that our Platform and its services collect, by itself or through third parties, including but not limited to trackers; usage data; various types of data; answers to questions; clicks; key press events; motion sensor events; mouse movements; scroll position; touch events (collectively the “personal information” or “personal data”).

We may obtain Personal Data relating to you from various sources described below. The information we will collect from you will depend upon the use of our Platform and its services. We will collect information from you when you subscribe to our services, visit our website, or contact us for our services. 

Unless specified otherwise, all Personal Data requested by our Platform and its services is mandatory, and failure to provide such Personal Data may make it impossible for our Platform to provide its services. In cases where our Platform and its services specifically state that some Personal Data is not mandatory, Users are free not to communicate this Data without consequences to the availability or functioning of the Service.

HOW WE MAY COLLECT DATA FROM YOU?

When you use or interact with our Platform and its services, we may obtain your Personal Data from various sources described below. The information we will collect from you will depend upon the use of our Platform and its services. We may collect the following information or personal data from you;

  1. User-provided Information:

  • Registration or Sign Up. You may not be required to sign up or create an account with us to visit our website and peruse its general contents.  But if you want to register for our Services, sign up for any events, subscribe to our blog(s) or newsletter(s), purchase and/or register domain names, or use any of our Services, you may need to sign up or register for an account with us and access to the user profile dashboard. To create an account, you must provide certain information such as your first name, last name, email address, user name, password, phone number, mailing address (including but not limited to city, state, country, zip code), etc.  We hereby disclaim, and you hereby release us from any and all liability arising from any unauthorized registration and from any related claims, losses, or damages alleged arising from or relating to any unauthorized user registration and/or collection of personal data in connection with an unauthorized registration

  • OAuth Registration/Login: We may have an optional o-authorization registration option with social media plug‐in tools like Facebook, Google, etc. Those tools may allow automatic registration and a direct connection with those social network servers through your browser, and the registration information will be transferred to us by those social networks. If you access our Platform with your login credentials from a social networking site or if you otherwise agree to associate your account with a social networking account, we may receive personal information about you from such social networking platform in accordance with the terms of use and privacy policy of those social networking sites. You are also subject to the social networking website’s terms of use and privacy policy

  • Profile or Account Information. To use certain features within our Platform, categorize and understand your purpose for using our Platform and its services, we may also ask you to complete your profile with us by providing certain of your personal data under the personal info section of the Dashboard, which may include your full name, email address, profile picture, and a phone number, mailing address, city, state, country, province, zip code, social media profiles/pages, Business Information, Personal Data contained in scanned identification documents (such as an ID card, driver’s license, passport, or official company registration documents), etc..   • Payment Information: We don’t locally process any payments or collect any payment information, or transfer it to us through our Platform and its services. Instead, we will only receive a notification from the relevant payment service provider whether payment has been completed. All payments will be handled through the secure gateway system on our Platform. We use Stripe and Mollie as our payment gateway, and WEMASY B.V. will not collect payment data. At the point of payment through the secure gateway system, you are transferred to a secure page of the Stripe and Mollie payment service provider, and any data collected through Stripe and Mollie will be governed by the Privacy Policy of Stripe and Mollie, which can be found at https://stripe.com/privacy  and https://www.mollie.com/nl/privacy 

  • Feedback or Review: We may also collect Personal Data if you include it in any feedback or comment you provide. Feedback or reviews from our users allow us to measure areas of interest, improve WEMASY B.V.'s efficiency and offerings, provide users with important information, and build features and functionality to enhance your experience with our website and services. You are not obligated to provide us with feedback or comments.

  • Communicate with WEMASY B.V. via live chat support or other ways: When any user or subscriber communicates with WEMASY B.V. using our Contact Us form, support email, phone call, or live chat option, we may collect personal data through such communications.

  • System Logs and Maintenance: For operation and maintenance purposes, our Platform and any third-party services may collect files that record interaction with our Platform (System logs) or use additional Personal Data (such as the IP Address) for this purpose. We may save your IP address in our logs for DDoS prevention for a period ranging from 6 months to 2 years maximum.

  • Contact Form/Others: You may also choose to provide us with information when you fill out our contact form, survey form, or update/add information to your account with us. By filling in the contact form, survey form, and adding/updating information with your Personal Data, you authorize us to use these details to reply to requests for information, quotes, or any other kind of request as specified in the form. 

  1. Data Automatically Collected via Technology When You Use the Services:

To make our Platform and its services more useful to you, our servers, hosted by third-party service providers, may collect information from you, including your browser type, operating system, Internet Protocol (IP) address (a number that is automatically assigned to your computer when you use the Internet, which may vary from session to session), domain name, and a date/time stamp for your visit. When you use our Platform and its services, we may collect usage information, location information, log data, cookies, and similar technologies, such as "clear gifs" or "web beacons." This automatically collected information may include your IP address or other device address or ID, web browser and/or device type, etc. We may use Google Analytics and other third-party vendors to collect information anonymously and report website trends without identifying individual visitors. Google uses its cookies to track visitor interactions.

  1. SERVER LOGS: 

Information about user actions is logged in the server layer and used solely for website administration purposes. This data includes:

  • Time of inquiry arrival

  • Time of response sending

  • User or End-Users station name (identified by the HTTP protocol)

  • Information about encountered errors during HTTP transactions

  • URL of the previously visited page (referrer link) when accessed via a link.

  • User or End-Users browser information and IP address

  • This data is not linked to specific individuals browsing the website and is solely used for website administration purposes

  1. Information we collect from other sources: 

We may use third-party Services or technologies which may process trackers and usage data in their businesses' principal places of operation. They may hold or store such data as per their policy. Regarding any third-party Trackers/Technologies, users can manage their preferences via the related opt-out link (where provided), by using the means indicated in the third party’s privacy policy, or by contacting the third party. We may also receive Personal Data about you from third-party sources, such as i) security providers, fraud detection and prevention providers for example to help us screen out users associated with fraud, ii) social media platforms, when you log-in or sign-up using your social media account, we may receive Personal Information from that service (e.g., your username, basic profile Personal Information) and in some cases, we may collect Personal Information from lead enhancement companies which help us to improve our service offering; iii) advertising and marketing partners in order to monitor, manage and measure our ad campaigns.

  1. End-Users’ ‘Personal Data’: 

We may gather, store, and handle specific Personal Data of our Users' customers ("End-Users Data") solely on our Users’ instructions. For instance, our Users can import their email contacts from services like Gmail or manage contacts through their User Website, with WEMASY B.V. storing this data on their behalf. In this context, WEMASY B.V. acts as a "Processor," not a "Controller" (as defined in the GDPR), of such End-Users Information. The Users who control and operate these User Websites are deemed the "Controllers" of such End-Users Information and are accountable for adhering to relevant laws and regulations concerning its collection and control, including privacy and data protection laws. The processing of End-Users’ Personal Information occurs within the European Union or a third country approved by the European Commission for ensuring an adequate level of protection. Any transfer and processing in a third country not ensuring such protection are conducted under approved mechanisms outlined in the Data Processing Addendum – Users ("DPA").

You're accountable for the security, integrity, and lawful usage of Personal Data about End-Users, including obtaining consents and permissions required for its collection and usage. While WEMASY B.V. doesn't provide legal advice, we advise all Users to maintain clear privacy policies on their User Websites in compliance with applicable laws. End-Users should review these policies and ensure their understanding and consent as required by law. If you're a visitor, user, or customer of any of our Users, please note that WEMASY B.V. processes Personal Data of End-Users without direct relationships with them. For any queries regarding your Personal Data, please contact the relevant User directly. If WEMASY B.V. receives requests from Users to delete End-User's Personal Information, we'll respond promptly and in accordance with applicable law. Unless instructed otherwise, we'll retain such information as long as we need to fulfill our obligations under this Privacy Policy.

WHAT ARE OUR METHODS AND PLACE OF PROCESSING YOUR DATA?

  • Methods of processing: We will take appropriate security measures to prevent unauthorized access, disclosure, modification, or unauthorized destruction of the Data. The Data processing is carried out using computers and/or IT enabled tools, following organizational procedures and modes strictly related to the purposes indicated. In addition to WEMASY B.V., in some cases, the Personal Data may be accessible to certain types of persons in charge, involved with the operation of our Platform (administration, sales, marketing, legal, system administration) or external parties (such as third-party technical service providers, mail carriers, hosting providers, IT companies, communications agencies) appointed, if necessary, as Data Processors by WEMASY B.V.. The updated list of these parties may be requested from the Owner at any time.

  • Place of Processing: All data collected through our Platform and its services shall be processed at our operating offices and in any other places where the parties involved in the processing are located. Depending on your location, data transfers may involve transferring your Personal Data to a country other than your own. 

  • Retention time: Unless specified otherwise in this document, Personal Data shall be processed and stored for as long as required by the purpose for which they were collected. They may be retained longer due to applicable legal obligations or based on the User’s consent.

WHAT IS OUR PURPOSE OF PROCESSING YOUR PERSONAL DATA?

We may also use machine learning to help us monitor, identify, and suspend accounts sending spam or engaging in other abusive or fraudulent activity. Subject to this privacy policy, the Personal Data collected from our user to provide our Service, comply with our legal obligations, respond to enforcement requests, protect our rights and interests (or those of its Users or third parties), detect any malicious or fraudulent activity, as well as the following: commercial affiliation, traffic optimization and distribution, contacting the user, analytics, displaying content from external platforms, spam and bots protection and handling payments.

  • Commercial Affiliation: We may have commercial affiliations with different entities or organization or service provider. This type of service may allow our Platform to display advertisements for third-party products or services. Ads can be displayed either as advertising links or as banners using various kinds of graphics. Clicks on the icon or banner posted on the application are tracked by third-party services and are shared with our Platform

  • Traffic Optimizations and Distribution: We may use different traffic optimization and distribution services, which may allow our Platform to distribute its content using servers located across different countries and optimize its performance. Which Personal Data are processed depends on the characteristics and implementation of these services. Their function filters communications between our Platform and the User’s browser. Considering the widespread distribution of this system, it is difficult to determine the locations to which the contents that may contain the user's Personal Information are transferred.

  • Analytics: We are using Google Analytics (Universal Analytics) and our own personalized analytics tools to monitor and analyze web traffic and can be used to keep track of User behavior. We may also record visiting sessions of our users. We are using this Analytics to track and examine the use of our Platform, to prepare reports on its activities, and share them with other Google services. Subject to these analytics, Google may use the data collected to contextualize and personalize the ads of its own advertising network.

  • Displaying Content from External Platforms: This type of service allows you to view content hosted on external platforms directly from the pages of our Platform and interact with them. Such services are often called widgets, small elements placed on a website or app. They provide specific information or perform a particular function, often allowing for user interaction. This type of service might still collect web traffic data for the pages where the service is installed, even when Users do not use it.

  • Spam and bot protection: We may use third-party Spam and bot protection services to analyze the traffic of our Platform, potentially containing User’s Personal Data, with the purpose of filtering it from unwanted parts of traffic, messages and content that are recognized as spam or protecting it from malicious bot activities.

  • Handling payments: Unless otherwise specified, our Platform uses Stripe and Mollie payments providers. You will be requested to provide your payment details and personal data directly to such payment service providers. Our Platform isn’t involved in the collection and processing of such information: instead, it will only receive a notification by the relevant payment service provider as to whether payment has been successfully completed.

If you use our Platform and its Services, we may collect, use and process your personal data in accordance with the terms set out in this privacy policy. The Personal Data we collect will be used to provide you with services or to sell goods, including for the following purposes (the “purposes”)

WEMASY B.V. follows a lawful basis for collecting and/or processing your personal information. We generally rely on several grounds (reasons) for this processing within our business activities. We process your personal data in accordance with the provisions set out in the GDPR of the EU, DPA of the UK, CCPA of the USA, and the relevant applicable territorial and international data protection laws and regulations. The legal bases for processing your personal information are:

  1. To comply with contractual obligations. When you wish to get any particular service we are offering through our Platform, that Service primarily determines the purposes of processing your Personal Data, and we will process your information so that we can provide that Service to you.

As a result of your consent. when you have consented to the processing of your personal data by us for certain services through the Platform, you can withdraw this consent at any time in accordance with the instructions provided in this privacy policy below or by contacting us at support@wemasy.com. For further information on the right to withdraw, please refer to the "Obligation to provide personal information" section below.

Examples of such situations are: i) to analyze and optimize our Website; ii) to guarantee IT security and safeguard our IT operations; iii) to prevent and investigate criminal acts.

  4. WEMASY B.V. has legal obligations it must follow, or there is a general public interest. WEMASY B.V. is subject to legal obligations and regulations like any other company. In some cases, processing your personal information will be necessary for WEMASY B.V. to fulfil these obligations.

BUSINESS OR OWNERSHIP TRANSFERS

If you upload user content to your User account or post it on your User Website as part of using any Service, you do so at your own risk. SOCIAL MEDIA PAGES/INTERACTIVE SERVICES:

If you interact with our Platform and through any interactive services or any social media pages like Facebook, Instagram, etc., you should be aware that the personal data you submit through such venues can be read, collected, and used by other users of these forums (depending on your privacy settings associated with the accounts you have with the hosts of such Social Media Pages). This information could be used to send you unsolicited messages or contact you without your consent. We are not responsible for the personal data you submit in these forums. The social media pages reside on a website ("Social Media Platform") that is operated independently from WEMASY B.V., and we are not responsible for such social media sites, interfaces, or privacy or security practices. THIRD-PARTY SERVICES

In general, the third-party providers we use will only collect, use, and disclose your personal data to the extent necessary to allow them to perform the services they provide to us. However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies regarding the information we must provide them for your purchase-related transactions. ADVERTISING AND ANALYTICS:

To promote our Platform and its services, we may use third-party advertising and analytics platforms, including but not limited to Google Ads, Facebook Ads, Google Analytics, Facebook's ad tracking feature, etc. We may also use remarketing or remarketing pixels through Google, Facebook, LinkedIn or other marketing channels. We do not share personal information that directly identifies you with third-party Advertisers for their direct marketing purposes.

  • Behavioural Remarketing: We may use Google, LinkedIn, Facebook, Hotjar etc.  remarketing services to advertise on third-party websites to previous visitors to our site. It could mean that we advertise to previous visitors who still need to complete a task on our site, for example, using the contact form to inquire. This could be in the form of an advertisement on the Google search results page or a site in the Google Display Network or somewhere on LinkedIn and Facebook. Third-party vendors, including Google, LinkedIn, and Facebook, use cookies to serve ads based on someone's past visits to the WEMASY B.V. website. Any data collected will be used, shared, or processed in accordance with this privacy policy, as well as the privacy policies of Google, LinkedIn & Facebook.

  • Google Ads and Analytics: Google AdWords remarketing service is provided by Google LLC.
